1. Acceptance of Terms
By accessing or using trygutfuel.com and any related services (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, please do not use the Service.
2. Description of Service
GutFuel is a personalized functional snack subscription service. Our products are functional foods designed to support gut health and general wellness. GutFuel is not a medical product. Our snacks and services are not intended to diagnose, treat, cure, or prevent any disease. These statements have not been evaluated by the FDA. Always consult your physician before making changes to your diet, especially if you are currently on medication.
3. Founding Member Deposits
- A $1.00 USD refundable deposit reserves your spot as a Founding Member and locks in founding member pricing for the lifetime of your active subscription.
- The deposit is applied as a credit toward your first full payment.
- Full billing begins when your first box is ready to ship. You will receive at least 7 days advance notice before your first full charge.
- Founding member pricing is locked in forever as long as your subscription remains active. If you cancel and later resubscribe, founding pricing is not guaranteed.
4. Subscription & Billing
- Subscriptions are billed monthly on the anniversary of your first shipment date.
- All prices are in USD.
Founding Member Pricing (locked for life):
- Core: $29/month (regular price: $39/month) — 20 snacks
- Plus: $39/month (regular price: $59/month) — 24 snacks
- Pro: $49/month (regular price: $79/month) — 28 snacks
Optional Add-On:
- Reserve Membership: $13/month (10% off all add-on purchases, free shipping, price lock, early access to new snacks)
- All payments are processed securely through Stripe.
- You may upgrade or downgrade your plan at any time from your dashboard.
5. Cancellation & Refunds
- You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of your current billing period.
- $1 Deposit: Fully refundable at any time before your first box ships.
- Post-Shipment Refunds: Handled on a case-by-case basis within 14 days of delivery. Contact support@trygutfuel.com.
- Partial month refunds are not provided for mid-cycle cancellations.
6. Account Responsibilities
- You are responsible for maintaining the confidentiality of your login credentials.
- You agree to provide accurate, current, and complete information during registration and to update it as necessary.
- You must be at least 18 years old to create an account and use the Service.
- You are responsible for all activity that occurs under your account.
7. Product Disclaimers
- GutFuel products are functional foods, not dietary supplements or medications.
- Our products have not been evaluated by the Food and Drug Administration (FDA).
- Always consult your healthcare provider before starting any new dietary regimen, especially if you are taking GLP-1 medications or other prescription drugs.
- GutFuel is not responsible for allergic reactions if you do not review the ingredient lists provided with each product. All ingredient information is available on packaging and in your dashboard.
8. Intellectual Property
All content, branding, logos, quiz algorithms, product formulations, website design, and related materials are the exclusive property of GutFuel LLC. You may not reproduce, distribute, modify, or create derivative works from any GutFuel content without prior written permission.
9. Limitation of Liability
To the maximum extent permitted by law, GutFuel LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total aggregate liability to you for any claims arising from your use of the Service is limited to the total amount you have paid to GutFuel in the 12 months preceding the claim.
10. Changes to Terms
We reserve the right to update these Terms of Service at any time. Material changes will be communicated at least 30 days in advance via email to the address associated with your account. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
11. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.
